Some important financial and legal documents require a notary public to confirm the legitimacy of a signature.
This verification process includes witnessing a signature to certify its authenticity when compared to proper identification.
The Illinois Notary Public Act (INPA) was established in 1986 to establish basic rules for proper safe notarization. Due to the COVID-19 pandemic, a new law (SB2664) was signed in 2021 as Public Act 102-160.
The updated legislation revised the INPA to allow for Remote Ink Notarizations (RIN) and Remote Online Notarizations (RON) in real estate transactions.
With remote notarization, a notary public can review documents remotely using audio/video technology (webcam, Skype, Zoom, etc.).
The signer’s identity is confirmed by the notary. Electronic signatures are required for signers. There is also a digital version of the notary public’s seal.
Benefits of Remote Online Notarizations (RON) include:
- Flexibility – Virtual document notarizations reduce the need for travel, schedule accommodations, office space, etc.
- Speed and efficiency – Paperless notarizations can provide easy and quicker access to documents and forms.
- Security and tracking – There is an electronic record and proof of the transaction, signatures, and certifications.
